1. Who you are contracting with
These Terms & Conditions ("Terms") form a binding agreement between you and TCI culture and island guide ("we", "us", "our") in relation to your use of the TCI Island Guide application and any related content (the "Service").
2. Acceptance
By creating an account, purchasing a pass, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your jurisdiction or have the authority to bind the organisation you represent.
3. The Service
The Service is a digital travel guide for the Turks & Caicos Islands, including curated content about beaches, restaurants, events, wildlife and culture. Some content (the "Explorer Pass") is unlocked by a one-time purchase and grants lifetime access from the account that made the purchase.
4. Acceptable use
You must not:
- Use the Service for any unlawful purpose, fraud, or spam;
- Infringe our or any third party's intellectual property rights;
- Attempt to interfere with the security or integrity of the Service, including by introducing malware, probing, or unauthorised scraping;
- Reverse engineer, resell, or redistribute the Service or its content;
- Circumvent technical limits or paywalls.
5. Account & credentials
You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
6. Intellectual property
We retain all rights, title, and interest in the Service, including its software, content, design, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes within the scope of any pass you have purchased.
7. Payments, billing & refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. 8. Service availability & warranties
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or will meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you have paid us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Suspension & termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time. Provisions that by their nature should survive termination will do so.
11. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws applicable to our principal place of business, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, subject to any mandatory consumer protection rights.
